Which of the following most accurately describes the problem?

A Cheshire operator has had its licence suspended until further notice, but North Western Deputy Traffic Commissioner Brian Horner has granted interim authority to a company formed to take over the business.

Preston on the Hill-based Carlton Pass had been called before the Deputy Commissioner because of concern over his maintenance record and the all ed unauthorised use of vehicles since his licence was cut from two vehicles to one at a previous public inquiry.

The Deputy Commissioner was also considering an application by Youd Trucks for a new five-vehicle licence from the same operating centre.

Horner said he had suspended Pass's licence at the beginning of October after he was not prepared to give some evidence. For both Pass and the company, Jonathan Lawton said the position remained. Pass was faced with a number of intended prosecutions and he was not prepared to tender him as a witness.

Adjourning the disciplinary proceedings, Horner said he was not prepared to allow Pass to operate and the licence suspension would be extended until further notice.

Conceding that Youd was the maiden name of Pass's wife, Lawton pointed out that the application had been submitted some time ago. He said that if the company was granted a licence Pass's licence would be surrendered.

The Deputy Commissioner indicated that he would not accept the surrender of that licence. His worry was the history of the Pass family's opera

tions and he was concerned that the company was "fronting up" to continue the business while the other licence was suspended.

Director and transport manager Thomas Thomason said the other director was Mrs Pass, who would be responsible

for the paperwork. He would ensure Pass had nothing to do with the running of the vehicles or with the business.

The OTC said he

was prepared to grant interim authority for the operation of two vehicles until the end of January, if an undertaking was given that none of the vehicles operated by Pass was included on the licence. Horner said he was prepared to give Thomason a chance to operate if Pass stood away from the business.
