Fired fined for driving prohibited vehicle

North-west London heavy haulier Justin Ffrench and one of his drivers have been ordered to pay £900 in fines and costs for using a vehicle subject to a prohibition notice. Driver James Brophy pleaded guilty to driving the vehicle and Ffrench, trading as Ffrench Heavy Haulage, of Hillside. Harlesden, pleaded guilty to permitting him to do so.
Prosecuting for the Vehicle Inspectorate, Anthony Ostrin told Feltham magistrates that during a maintenance investigation a vehicle examiner imposed a delayed prohibition on the vehicle after finding loose bolts on the gearbox flange and insecure nuts on the suspension.
The prohibition was delayed for a period of seven days, but a tachograph record showed that on the day after the prohibition came into force Brophy had driven the vehicle. Both men said that it had been "a misinterpretation and a mistake" on their part.
The magistrates fined Ffrench £400 with £200 costs; they tined Brophy £200 with £100 costs.
