AN INTERNATIONAL operator lost its bid for an 0-licence after an inquiry heard that it had been operating for a year without one, following the failure of a previous company.

Vaxo, which was trading as CDG Uansport, had sought a new international licence giving authorisation for five vehicles and two trailers operating out of Willenhall before Fiona Harrington, the West Midlands Deputy Traffic Commissioner.

The DTC was told director Stephen Famell had previously been in business with his brother in CDG Transport Services, which operated from the same Willenhall premises using the same vehicles.

This particular company is now in liquidation. An investigation was carried out after intelligence showed that vehicles were being operated in a dangerous condition without an 0-licence in an operating centre that was considered a death trap. In addition, safety inspection records were missing.

The one vehicle examined was given a delayed prohibition for long-standing defects. Fame]] was aware that it was an offence to operate without an 0-licence.

He had admitted that one vehicle was in Greece that day and that another was collecting a load in Lancashire. Famell said that the previous firm had operated seven vehicles and two trailers from the site He thought he had authority to operate under the old licence until June 2008 (CM 12 February).

Harrington said that she did not accept that as a credible enough explanation.

If Famell believed the company had the authority to operate on that basis, why did he not explain that to the VOSA officers when questioned about the operation of the two vehicles?

She believed Farneli had chosen not to be wholly honest with her.
