This person's insurance company is contesting the claim by stating that the coach was off the road longer than reasonably necessary—we had to waft a week for spare body parts! Can you advise us? Also would it be possible to provide for loss of use in our comprehensive policy?

AInsurance companies will naturally challenge loss of use claims if they appear excessive and also are unsupported

by a detailed cost break-down. You must of course take every possible action to minimize your loss, by hiring if necessary. Any replacement vehicle hired should be directly comparable with your own, unless you can prove such a vehicle was not available.

If your own insurance is arranged through a broker he will doubtless, for an additional fee, negotiate with the third party's company.

Alternatively as you are a member of the Passenger Vehicle Operators Association it might be as well to allow an official to scrutinize your figures, and amend accordingly. We feel sure that an insurance company, particularly one which is slow in settling claims, would take more notice of an association than of a small operator.

Finally if the suggested measures are unsuccessful, and if you are still sure in your own mind that your estimate is a reasonable one you should place the matter in the hands of solicitors.

Loss of use clauses are not normally included in comprehensive policies. Some insurance companies will make the necessary arrangements providing an additional premium is paid.
