• The High Court has ruled that Jersey is part of the UK for the purposes of the international carriage of goods by road.
The court dismissed an appeal by Chloride Batteries and the State of Jersey Telecommunications Board, against a decision that a contract with Jersey haulier F & W Freight, for the carriage of batteries between Manchester and Jersey, was not international carriage.
Giving judgement, Lord Justice Dillon said that a consignment of batteries had been destroyed by fire during the journey. If the plaintiffs sued F&W Freight in Jersey, the company could rely upon exemption clauses in the contract. If, however, as the plaintiffs argued, the Convention for the International Carriage of Goods by Road applied, it would prevent F&W Freight from relying on those exemption clauses. Looking at the Convention, it was clear that a country's dependencies should be regarded as part of that country.
