Which of the following most accurately describes the problem?

A FAILURE TO obey a Vosa officer's directions to stop has cost Manchester owner-driver John Henderson £515 in fines and costs.

Henderson, trading as Flying Freight. denied the offence, but was convicted by Rochdale magistrates.

Producing video evidence of the incident. Vosa enforcement support officer Christine Woodhouse said she was on duty in a Vosa-marked patrol vehicle on the M62 when she decided to stop an artic that was being driven by Henderson.

She overtook the vehicle and indicated to the driver with amber lights and matrix to -Follow Me Road Check Ahead". As she indicated to come off at Junction 20, she noticed Henderson's vehicle did not indicate to follow her off the motorway. She continued on past that junction to the next one, with the amber lights and matrix flashing. Henderson followed her off at that junction to the second roundabout. She indicated right to go round the roundabout to return to the motorway in the opposite direction. Henderson flashed his lights but failed to follow her and continued on his journey towards Milnrow.

Henderson said that when he had first been overtaken he had not initially noticed the lights on the Vosa vehicle. He noticed the lights when the vehicle got in front of him as he was overtaking a truck in the nearside lane. He had been unsure at first whether the lights were for him. Once he had completed overtaking, he realised the lights must have been intended for him. He had followed the car down to the roundabout. When the Vosa car turned back down the westbound ramp, he had thought it could not be him that she wanted. He had flashed his lights to attract the attention of the officer to see if she wanted him to stop. and had gone round the roundabout again to see if she had stopped to speak to him. He added that the whole matter was "a genuine mistake".

In reply to John Heaton, for Vosa, Henderson said he was on a journey to Sunderland to pick up Nissan car parts for delivery to Manchester Airport, He agreed it was a timed delivery, but denied he was anxious to be on time and refused to confirm what the window for collection was. He also agreed he was aware there was a nearby Vosa check site at Thomham Island.

The magistrates fined Henderson €250 with £250 prosecution costs and a £15 victim surcharge.
