Two men have been charged with the manslaughter of Homebase truck driver Derek Bailey during an arson attack. Chris Tindall reports.

TWO MEN CHARGED with the manslaughter of 1ruck driver Derek Bailey who was burned alive while sleeping in his cab, appeared at Hull Crown Court last week.

Bailey awoke to find his cab engulfed in flames after he had parked outside a Homebase store in Grimsby for the night. He was immediately overcome by smoke and heat and was unable to escape in time (CM9 October 2003).

Darren Wringe, 42, and Kevin Fielding. 38. both from Grimsby, deny manslaughter and arson.

The court was shown CCTV footage of Homebase's delivery yard the night Bailey died in June last year. At 11.45pm. Wringe and Fielding were identified rooting around in a skip next to the Scania which Bailey drove for Barnstaple-based CH Brannan.

The men then disappeared from view, but minutes later the cameraspickedup flickering light from the direction of Bailey's truck and nearby pallets.

Witnesses described a "horrendous" explosion that could he heard a mile away. Passers-by were unable to get near the truck because of the extreme heat.

Fielding initially denied knowing Wringe after his arrest his friend even swore "on his kiddies' livesthat he was not involved. They both later changed their stories and admitted they were in Homebase's delivery yard.The Court later heard that Wringe had been jailed twice before for arson offences.

For the prosecution, William Harbage QC told the court how both men changed their appearance the day after the tire; both had had their hair cut. Harbage said it was a 'cut-throat' defence: "Is one telling the truth and the other lying or are both lying? Each claims to have lied to protect the other."

He added that the arsonists must have known someone was asleep in the cab as the curtains were drawn.

The trial continues.
