What licence must the driver hold?

As a Class I hgv driver, am I legally entitled to drive it, and 4" not would I then be entitled to drive it if the passengers were carried free of charge? Does the driver need to complete and maintain a driver's log book?

AIf the passengers are charged a fare then the vehicle will be used for hire and reward and it becomes a public service vehicle as defined in Section 117 of the Road Traffic Act 1960. In that case, the driver must hold a psv driving licence and a Class I heavy goods vehicle driving licence is not valid for this purpose. If the passengers are carried free of charge it is not a psv and an ordinary Part III driving licence would be appropriate. The driver would not have to keep records; indeed, he need not observe the permitted driving hours.
