BRITAIN could be the first :-.ountry to defy a ruling of the European Court of Justice — and the ruling concerns the tachograph.

Now that the Common Market has taken the first step towards Court proceedings against the British Government for not enforcing the use of the instrument, if the case goes against Britain, the Government will probably ignore the verdict.

The European Commission has sent a letter to Transport Minister .William Rodgers giving him 30 days to explain the violation.

But Mr Rodgers said, last week, he is "playing it cool".

A British spokesman said, in Brussels, the Commission was "within its rights" to take Britain to court.

Although a Court ruling is not expected for at least 18 months, feeling against the tacho is not expected to change, and officials at the Commission are worried that it may be the first time a Court decision is not heeded.

They are anxious that it could be politically grave for Britain, to the extent that it could constitute a Community crisis.

Informed officials claimed that the Commission would not have gone ahead with proceedings if Mr Rodgers had not, earlier, shown public contempt for the regulation.

"That was more than they could bear," said one official.
