Plaintiffs claimed damages for breach of contract, alleging that a Commer 2tonner with certain alterations which they bought from the defendants for £1,226 4s. 7d. in June, 1952, was a 1951 model and not a 1952 model, as agreed. The defendants contended that the lorry was new, unused and that no representations had been made by plaintiffs that it should be a 1952 model.

Mr. Justice Ormerod said that the plaintiffs had bought the lorry by hire purchase. In the agreement the vehicle was described as unused, delivered from the makers that year, and fulfilling current specifications. This was entirely wrong and the defendants knew it.

The contract had been carried into effect by the defendants' warranty and this was broken, said the Judge. What was warranted was a 1952 model, but a 1951 model was delivered. The plaintiffs were entitled to recover the difference in value between the two.
