An Oldham haulier has had his licence revoked after North Western Traffic Commissioner Beverley Bell said he showed "a cavalier approach to the 0licensing legislation".

The TC had previously adjourned consideration of disciplinary action against Stephen Garforth. trading as Ainsdale Transport, because she wanted further investigations to be carned out. Garforth held a licence for seven vehicles and seven trailers.

Traffic examiner Susan Mullen had told the first hearing that an examination of tachograph charts had revealed speed limiter problems with five vehicles and a number of breaches of the hours and tachograph rules ( CM20 Dec-2 Jan).

When the hearing resumed. Mullen agreed with James Backhouse, for Garforth, that an analysis of tachograph charts since the last public inquiry showed a considerable improvement.

Traffic examiner Christine Finnegan said driver Graham Foster had created two false records and had driven while disqualified. Garforth said Foster had moved house and had been unaware of his disqualification.

The tachograph records were now sent for outside analysis and everyone at the firm had taken training on drivers' hours and tachographs. He also checked the tachograph charts himself to ensure that the speed limiters were working.

Backhouse maintained that Garforth had properly addressed the problems and was doing a lot that was right, with nothing that raised continuing concerns. Garforth had failed to appreciate the significance of speed limiters until it was brought to his attention by the Vehicle Inspectorate.

Bell said that it was not disputed th there had also been a number of conv bons for overloading, hours and tachogral offences. Overall the convictions went the root of Garforth's fitness to hold licence.
