• Wetherby magistrates have ruled that there is no obligation on drivers of vehicles operating under the special types provisions, limited to a maximum speed of 19lanili to use a tachograph. They recently dismissed charges brought by the North Eastern Licensing Authority against GCS Johnson and driver Derek Foster. They also ordered the prosecution to pay 2200 towards defence costs.

Foster denied failing to use a tachograph on the Al last June while the company denied causing the offence. The court heard that following previous prosecutions for technical overloading offences, after a tachograph chart had shown a special types vehicle had exceeded the 191cm/h speed limit, drivers had been instructed not to use tachographs and to keep a manual record.

Michael Paterson defending said that under the European Economic Community regulations, drivers or vehicles of a maximum authorised speed of 30Icm/h were exempted from keeping a tachograph record.
