THE TRANSPORT TRIBUNAL has dismissed an appeal by Rainham, Essex-based GPA Transport against the revocation of its licence by the then SouthEastern and Metropolitan Traffic Commissioner Christopher Heaps.

Jeremy Fear, for the company, complained it was taking the Leeds Central Traffic Area Office Unit months to process licence applications, even applications for interim authority.The company held a licence for two vehicles and two trailers. Its one trailer was given a prohibition for loose wheelnuts; when it was presented for clearance, clearance was refused. The licence was revoked after the company failed to respond to letters from Vosa and the Traffic Area Office (TAO) asking for an explanation.

Fear conceded that the TC had been entitled to revoke the licence in the absence of any response from the company. However, he said a package of information had been posted to the TAO and had simply not arrived.

He accepted that the most appropriate course was for the company to apply for a fresh licence but said that all applications now being made to the Leeds Central Unit were taking months to process. Even an application for an interim licence could take a considerable period to process.

Dismissing the appeal, the Tribunal said the TC's decision to revoke the licence could not be criticised. An application for a new licence should be made forthwith.
