AWhen considering action against the holder of an 0-licence, under Section 69 of the Transport Act 1968, an LA can take into account convictions recorded during the past five years. The relevant convictions are listed in Section 69 (4) of the Act as speed, weight and licensing offences; offences against the 0-licensing provisions: drivers' hours and records offences; failing to pay the statutory remuneration to employees as laid down by the Road Haulage Wages Act 1938; unlawful use of rebated fuel; failing to inspect vehicles and failing to keep records of vehicle inspections, parking offences; and using a vehicle prohibited under Section 57 of the Road Traffic Act 1972.
