T'Minister of Transport has allowed an appeal by four tour operator's against a decision of the North Western Licensing Authority granting permission to Wallace Arnold Tours, Ltd., to operate groups of excursions from Rochdale Manchester, Preston and Bolton, and to vary the con'ditions attached to thern licences. The tours were acquired from another operator.

He has ordered the deletion of a tour to Bournemouth and the south coast, and has amended the conditions to provide that the other excursions and tours shall operate only from the first Saturday in June until the first Saturday in October, inclusive, and that the maximum number of vehicles used on thegroup on any day shall be nine.

James Smith and Co. (Wigan), Ltd., Auty's Tours, Ltd., W, Robinson and Sons (Gt. Harwood), Ltd., and Batty Holt Touring Services, -Ltd., Were the appellants. The inquiry was held by Sir Maurice Holmes in September.

The Minister states that his decision should not be taken as implying that in his view a licence to authorize a purchaser of a business to continue a group of excursions and . tours should never go beyond what was provided under the vendor's licence.

On the other hand, he could not agree on the facts of the appeals in question that the grant of the licences to the purchaser for services which " amounted' in essence to a substantial transformation of the services" operated by the vendor, could be justified without proof of need.
