AN attempt by Harker Bros., Appleby, to sell a special A licence which had been revoked resulted from a misunderstanding, Mr. I, A T. Hanlon, the Northern Licensing Authority, was told at Kendal on Tuesday.

Mr. T. H. Campbell Wardlaw, for Harker Bros., said that on July 29, 1958, they applied for a public A licence for a vehicle of 4 tons unladen to replace a vehicle specified on special A licence at 2 tons 18 cwt. The vehicle was purchased from K. and B. Motors (Newcastle), Ltd., and when reweighed was 3 tons 17 cwt., although operated in the same condition as received. The special A licence was revoked, but a short-term licence was granted pending the hearing of a substantive application,

Mr. N. Harker said their main business was farming. After failing to get satisfaction from K. and B. Motors, they approached the Road Haulage Associa

tion. who advised an application for an A licence. When the vehicle was first reweighed it had its full equipment but this should have been removed. A further weighing without equipment caused the vehicle to be redecIared at 2 tons 19 cwt.

The short-term licence was withdrawn recently and the special A licence returned. He thought the matter was closed and contacted Mr. G. Allinson. Bishop Auckland, to sell the licence.

Mr. Hanlon said the applicants knew the licence had been revoked for the past 12 months. It had been returned because of a submission that it was not possible in the circumstances to grant a short-term licence. Consequently, the revocation had been temporarily suspended.
