Using a vehicle with a defective speed limiter has cast Mold, North Wales-based tipper operator Stuart Ratcliffe .£400 in fines and £80 costs. Ratcliffe, who trades as S Ratcliffe Haulage, failed to appear before Wirral magistrates and was convicted in his absence.

Prosecuting for the Vehicle Inspectorate, Jim Dorman said that last December a four-axled tipper loaded with spoil was checked on Dock Road South, Bromborough. The speed limiter system was disconnected in the engine compartment— the actuator cable had become detached from the variable link assembly, which was mounted on the engine's fuel pump governor lever.

The detached points of the cable end and the variable link assembly had become coated with grime and road dirt, indicating that the speed limiter assembly had been detached for some time.

When asked why he was using the vehicle with the speed limiter disconnected, Ratcliffe replied that he was waiting for the parts to repair it.
