Which of the following most accurately describes the problem?

for work for which he was never paid has received a letter from the same disqualified director offering Continental work for his latest business venture.

Jeff Lewis was jailed in December 2001 after being convicted of fraud at Blackfriars Crown Court following his involvement in several freight firms where he ran up huge debts, Although he was banned from being a director for 12 years, Lewis set up another freight forwarder, London-based Tree Freight, after his release. He now operates as a sole trader.

Lewis recently faxed Felixstowebased Brinor International Ship ping & Forwarding, which had served a County Court Judgement against his company in the early 90s, offering it international work. Its owner, Peter Brooks, says: We can't believe he keeps cropping up. We have a strict policy of getting new companies checked and when I heard his name I said 'don't touch it!'."

Lewis says faxing Brinor was a mistake: "They must have appeared on our database. I had forgotten; otherwise I wouldn't have done that. I am sorry that it happened."

He claims to have settled a £9,000 dispute over non-payment with a Lancashire-based firm (CM 27 May 2004): "They took us to court and we lost."
