A three-week suspension of the licence held by Hinchcliffe Bros Skip Hire 119851, trading as Raven Skip Hire, of Dewsbury. has been upheld by the Transport Tribunal despite claims that it would destroy the company's business.

The company's licence was suspended by North Eastern Deputy Traffic Commissioner Brian Horner after its second appearance at disciplinary proceedings within five months. Horner was considering Hinchcliffe's maintenance, convictions and financial standing.

The licence had been cut from 10 vehicles and two trailers to eight vehicles and two trailers at a previous public inquiry: the DTC decided a further cut would cause inappropriate harm to the b ness. He said suspension was "a short and sh reminder of the company's responsibilities".

Colin Ward, for the company, argued that DTC had given insufficient consideration to effect of a suspension. He said it would lea( the loss of contracts and destroy the busini Skip hire was highly competitive, it requi special vehicles, and any contract that could be continuously performed would be lost.

Dismissing the appeal, the Tribunal there was evidence from the company tha had more work available than it could co with eight vehicles—there was work for 12 oi vehicles. They felt the DTC was entitled to t the view that the business was flourishing would withstand a period of suspension.

As it was. he was faced with an opera whose licence had recently been curtailed who had continued to incur prohibition noti and convictions.
