Which of the following most accurately describes the problem?

• North Western Traffic Commissioner Martin Albu has granted Specialist Vehicle Transportation the authority to change its operating centre.

Albu was considering the application in the light of the company's lack of a full-time transport manager and a previous employees failure to notify the Traffic Area of a change of operating centre.

The company holds an international licence for six vehicles and six trailers and had applied to change its operating centre to Brooks Lane, Middlewich.

Managing director David Bailey said the company was started 15 months ago with Paul Stroud as the only director. Bailey joined the company at the beginning of 1993 and two other directors were appointed in June and July. It became obvious that the business was not running properly. Stroud resigned as a director but in April last year became the company's consultant transport manager. The company moved to Brooks Lane in August and it was Stroud's job to notify the Traffic Area. When the variation application was made it became obvious that a previous move in 1992 had never been notified to the Traffic Area. Stroud's contract was terminated in September and he was being sued for incompetence.

A Mr Johnson had become CPC holder, said Bailey. He was not employed by the company because one of the directors was going to take the CPC exam. Johnson had his own company and was in their yard three or four days a week.

Albu said the unauthorised use of an operating centre was serious, but accepted that the present directors were not responsible. He felt Stroud's repute was doubtful, but the present company had not lost its good repute, He did not feel that Johnson met the technical requirements for a transport manager but he would allow the company to operate without one on the understanding that Johnson would fill the gap and the director passed his CPC and became the transport manager.
