Which of the following most accurately describes the problem?

THE UNAUTHORISED use of a vehicle and failing to use a tachograph has cost London-based Thomas Dowling and driver David Clohessy almost £700 in fines and costs.

Dowling pleaded guilty at Hillingdon magistrates Court to using a vehicle without an 0-licence; he was fined £300 with £175 costs. Clohessy pleaded guilty to driving the vehicle without using the tachograph: he was lined 00 with £115 costs.

Anthony °strut, prosecuting for Vosa, said traffic examiner Barry Spurling had checked a Daf 7.5tonner loaded with household rubbish.

When asked why he was not using the tachograph, Clohessy had said Dowling had just taken the vehicle for its MoT and he thought it was exempt. In fact this exemption only applies when the vehicle being taken for test is unladen.

Dowling was later interviewed and admitted he did not hold an 0-licence — Ostrin told the court that no valid explanation had been given for this.
