Aldous, for the Lines Trailer Co., Ltd., moved for an interim injunction to restrain Crellin-Duplex (Holdings), Ltd., from granting any licence in respect of Letters Patent No. 642,172, except with the plaintiff's consent, and from representing that the plaintiff was not the exclusive licensee under the

patent. .

Mr. Aldous said that the plaintiff claimed to have obtained an exclusive licence from the Falgar Motor Co. for the manufacture of the Crain Duplex coach body, the subject of the patent which had been assigned by Mr. G. Crellin to the Falgar. Motor Co. It was alleged that the defendant had represented that the plaintiff's licence had been cancelled and this was causing serious damage. The agreement to grant the exclusive licence was for three years from May I, 1950.

Mr. L. A. de Pinna. for the defendant, submitted that the dispute between the parties should be referred to arbitration.

Mr. Justice Wynn-Parry stated that the defendant company was alleging that it was not bound by the agreement. That was not a dispute which was referable to arbitration.

The evidence, as it stood, was all one way. The defendant could file evidence, but in the meantime he would grant the plaintiff the .iniunetion claimed over next Friday [to-day].

Mr. de Pinna asked for leave to serve a cross notice of motion claiming an arbitration and Mr. Justice WynnParry said that the defendant could launch the motion for April 27.
