• Lichfield magistrates have cleared Econ. ofreight Heavy Transport of allowing a heavy haulage vehicle to be driven by an unqualified driver. The company pleaded not guilty to letting Philip Birkbeck drive an HGV when he was not the holder of the relevant licence.

The court heard that Birkbeck was unable to produce an HGV licence after his Volvo artic was involved in an accident in October 1990. Inquiries indicated that he did not hold a licence.

Managing director Tom Llewellyn said that Birkbeck had a current HGV driving licence when he was employed and it had been regularly renewed.

Stephen Kirkbright, defending, argued that the prosecution had not proved that anybody knew that the vehicle was being driven by Birkbeck when he was without an HGV driving licence.
