B KENNEDY Commercials has won its bid for an interim O-licence after a Deputy Trafic Commissioner (DTC) said the company had taken “positive steps” since a failed application last year.

Following a public inquiry in Edinburgh in March, Simon Evans, DTC for Scotland, granted the Lasswade, Midlothian-based haulier temporary authorisation for one vehicle and one trailer.

In April 2010, Tom Macartney (right), another DTC for Scotland, said the irm was not of good repute and did not meet the inancial standing requirements.

Macartney added that Darlene Bell, a director at B Kennedy Commercials, had “very little knowledge about, and no experience in, the haulage industry” , having previously been employed as a social worker at East Lothian Council.

However, in the latest ruling, Evans said the irm’s current bank balance was “adequate” and that “positive steps” had been taken by the business towards becoming compliant. The DTC welcomed the steps taken by director Brian Kennedy to take a CPC course, involve his mother Linda Kennedy in the business, and appoint an experienced transport manager, David Donald.

He added: “At the time of earlier applications there was evident lack of focus, almost constant change and uncertainty and a very clear lack of understanding of the particular processes of the regulatory regime. “Mrs Kennedy says that she will now take a proper role with the business. I have no reason to doubt her sincerity in this regard and accept that she can provide a check on her son, which will be important. Mr Donald is a well-experienced transport manager with a clear understanding of the requirements.” Evans also granted related company LJK Scotland, directors Brian and Linda Kennedy, an interim licence for one vehicle and one trailer. Both applications will be looked at again after six months.
