A PEVENSEY operator, who sought the return of an impounded vehicle to help pay his debts, has had his application rejected by Christopher Heaps,the South Eastern & MetropolitanTraffic Commissioner.

Brian Tingley told the TC he was the registered owner of the vehicle, and that he was going through an Individual Voluntary Agreement as an alternative to bankruptcy. The sale of the vehicle was part of his IVA agreement, and it was in the process of being sold to Paul Scott for £10,000. Scott had cleared the outstanding finance of £68.62. Tingley had allowed Scott to take the vehicle as he had said he had all the relevant licences in place.

Traffic examiner Jeremy Betts said the loaded vehicle had not been displaying an 0-licence disc.The driver had said he was working for Paul Scott. It had been confirmed Scott did not hold an 0-licence and the vehicle was impounded. The vehicle was the subject of a hire purchase agreement between Tingley Independent Traders and Anglo Irish Finance: Tingley Independent Traders was in compulsory liquidation. Refusing to return the vehicle, the TC said it seemed to be owned either by Tingley Independent Traders or by Scott. He had no evidence that it was, or had been, owned by Tingley
