Which of the following most accurately describes the problem?

A SHROPSHIRE haulier has had its licence suspended for carrying out a hire-or-reward operation using a farm tractor running on red diesel. Telford-based SP Holding Services had been called before West Midland Deputy Traffic Commissioner Tim Hayden. The company holds a licence for eight vehicles and eight trailers.

The DTC suspended SP's licence for three days after hearing from vehicle examiner Keith Algrante. He said that during a spot check at a waste disposal site he saw an agricultural Fastrac tractor towing a two-axled tipper trailer loaded with soil enter the site. An immediate Smarked prohibition, indicating a serious lapse in maintenance, was issued to the trailer for having disconnected brakes, no indicators or brake lights working and no number plate displayed.

On finding red diesel in the tractor, he contacted HM Revenue & Customs, which impounded the vehicle. No 0-licence disc was displayed and as the tractor was being used for hire or reward, the driver was not correctly licensed. No other prohibitions had been issued in the past five years and overall he was satisfied with the firm's procedures. The trailer concerned was an off-road vehicle outside the scope of 0-licensing.

Director Paul Holding said it was 100 yards between the company's premises and the waste disposal site Generally the tractor, although taxed as a CV, had only been used on agricultural work.

Application had since been made to specify the tractor on the 0-licence. A computerised fuel system had since been installed at a cost of £35,000 and the tractor was now programmed for white diesel only. There was a roadworthy trailer that the driver could have taken, but he loaded an agricultural trailer with soil. Checks were now made on all vehicles leaving the premises.

Not a regular offender

In concluding that it was unnecessary to take the company off the road, the DTC took into account its good overall record.
