stripa ore used in steel production was not "building material" the Queen's Bench Divisional Court ruled last week that magistrates sitting at Worksop, Notts, were wrong in dismissing a summons against Mr, Sydney Brown and Mr. William Brown, trading as A. Vaughan and Co. of Worksop.
Mr. Justice Widgery, sitting with Lord Parker (the Lord Chief Justice) and Mr. Justice John Stephenson, said the Browns had a B licence which allowed them to carry building materials for distances under 30 miles, agricultural products up to 40 miles and other goods up to 20 miles. The magistrates found that the stripa ore was being carried more than 20 miles, but less than 30. The Browns contended that it was a build:ng material. The magistrates, being in doubt, had dismissed the summons.
Mr. Justice Widgery said that stripa ore was a very long way from coming within the meaning of building materials" and Lord Parker and Mr. Justice John Stephenson agreed.
The court remitted the case to the magistrates with a direction to convict.
