Go and persuade LA, tribunal tells haulier

A CAMBRIDGE operator has failed in an appeal to the Transport Tribunal in London and has been told by Tribunal president George Squibb to persuade the Licensing Authority for the Eastern Traffic Area that things have now improved. with a commercial garage and vehicles are now coming in on a regular basis. S. and H. Marine Airfreight Co Ltd (trading as MAF Co) has had an Operators licence since January 1979 for four vehicles. The LA suspended two of the vehicles on the licence for four months because he was concerned with the statements of intention made on the company's original 0-licence application.

The vehicle examiner was dissatisfied about vehicles' records and with maintenance and inspection procedures.

The company started by using local mobile fitters and "drifted away from its original intention,'" accrding to its solicitor, Mr Holder. A steering defect on one of the vehicles was due to a lapse by one of the mobile fitters, he said.

The company is now back Mr Holder said the company had four vehicles and employed three drivers. If the suspensions were enforced, two men would be made redundant because the company "'cannot slide back to using two vehicles then go back to four in four months' time.''

"It would be too harsh a penalty to lose the whole business, and -this has been a lesson for the company. The seriousness of the company's obligations and undertakings wasn't appreciated,'" said Mr Holder.

Mr Squibb dismissed the appeal and said the suspension was effective from August 1.
