Which of the following most accurately describes the problem?

• In the first of a series of prosecu tions involving milk delivery vehicles to come before the Llanelli and Swansea magistrates, a Carmarthenshire owner-driver has been fined for unauthorised use and using a vehicle fitted with a defective tachograph.

Ross Andrew Moyse, of Cefn Du Farm, Llanfyrnach, pleaded guilty to the offences before the Llanelli magistrates. lie was fined .1:300 and ordered to pay £55 prosecution costs.

Prosecuting for the Vehicle Inspectorate, William Rees told the court that it appeared the

company's drivers were being told they were exempt from the tachograph and other goods vehicle regulations because they were delivering the milk within a 50mile radius.

That was a misreading of the regulations, said Rees, as the 50mile limit was intended for door-to-door deliveries, and here they had found crates of milk being delivered to depots.

Rees said that Moyse, who was working as a subcontractor delivering milk for Elm Dairies, had been stopped in the early hours on the A476 trunk road at Cross Hands, The magistrates fined Moyse £150 per offence.
