WEST MIDLANDS Traffic Commissioner (TC) Nick Jones has revoked the 0-licence of Paul Green and Jennifer Green. who traded as P&J Green, saying the pair had showed -a very poor understanding of basic management principles and of operator licensing".
In a written judgement following a public inquiry held in April. the TC revoked the partnership licence for seven vehicles from 30 August, and disqualified them from holding or applying for an operator's licence in any Traffic Area for a period of six months.
VOSA traffic examiner Tracey Love told the hearing that the Greens vehicles had been registered in the name of limited company MJ Haulage UK. which had no licence to operate.
She said VOSA officers had warned Paul and Jennifer Green on numerous occasions'. that MJ Haulage did not have authority to operate vehicles.
At the hearing, various drivers employed by the business were given formal warnings relating to tachograph and drivers' hours offences as a result of a lack of awareness of the rules.
The business had no written disciplinary procedures, drivers did not have formal contracts of employment, and there were prohibition notices against it.
Jones suspended Paul Green's HGV driving licence for a period of two weeks from 30 August, and also held that the transport manager for the business, Terence Sheppard, had lost his repute.
The TC added: "Despite claiming that they had given formal written warnings to drivers, there was no written disciplinary policy. "Warnings were unsigned, warnings were included for matters that should not have been subject to discipline, an example being 'exceeding break times: It is an offence to fail to adhere to the minimum break times, but not to exceed a minimum break time.
Jones also rejected an 0-licence application from MJ Haulage. with its directors listed as Jennifer Green and Natalie Scott, although the latter had ceased to be a director by the time of the hearing.
