Which of the following most accurately describes the problem?

• Bloxwich haulier Edgar Davies was granted authority to move his operating centre to a neighbouring site, after an objection by Walsall Borough Council was declared invalid by West Midland Deputy Licensing Authority Roger Seymour.

Davies, who holds a sixvehicle international licence, wanted to move his operating centre from Bailey Bros Yard, The Sneyd, Wolverhampton Road, to Sneyd Cottage, Wolverhampton Road. A representation from Bailey Bros was withdrawn after an access dispute was settled.

For Davies, Jonathan Hendley said that a copy of the council's objection had not been received.

On behalf of the council, David Pell said he understood that a copy of the notice sent to the Licensing Authority had been sent to Davies with a compliments slip. The council's objection lay under S69B(1) of the Act, on environmental grounds. Hendley pointed out that the regulations required that the grounds of the objection must be stated.

Seymour was satisfied that the operating centre was perfectly adequate for Davies's purposes and there were no environmental implications.
