Which of the following most accurately describes the problem?

I have been driving a Bedford 53-seater coach [six-wheeler) for a. small .firm, for some six years or more, as well as a 7ton lorry. The owner has now retired and the coach has been sold for conversion to a horse-transporterwhich will he used for hire and reward.

I have been offered the job of driving this vehicle, hut have been told that I will have to take a Class 2 hgv test before I can da so. is this correct?

A You will need a Class 2 heavy goods vehicle driving licence to drive the vehicle you describe when it is converted.

The reason is that the driver of a public service vehicle is exempt from the requirement to hold a heavy goods vehicle driving licence under Regulations 28(c) of the Heavy Goods Vehicles (Drivers' Licences) Regulations 1969. In fact, a heavy goods vehicle is described as vehicles of certain classes which are adapted or constructed to carry goods or burden of any description. Passengers cannot be classed as goods or burden and therefore, a passenger vehicle is not a heavy goods vehicle.

When that passenger vehicle is adapted to carry goods or burden then its classification alters. In other words, it becomes a heavy goods vehicle if its unladen weight is such as to bring it within that class. In that case, an hgv driving licence is necessary to drive it.

A vehicle of this nature which has more than four wheels in contact with the road surface requires a Class 2 hgv driving Licence. However, if you were driving the vehicle for six months, or periods which amount to six months in aggregate, between February 2, 1969 and February 1, 1970, and your employer can substantiate that claim, you might be able to obtain a Class 2 licence without taking a test. You should ask the Licensing Authority if he is prepared to grant a licence under the circumstances which you have described.
