nECISION on an appeal which was stated to raise the question as to what an applicant had to prove to justify additional tonnage on an. existing A licence, when he offered to surrenderequivalent tonnage under a. special A licence, was on Tuesday reserved until yesterday. The Transport Tribunal were hearing in Edinburgh an appeal by the British Transport Commission against the Scottish Deputy Licensing Authority's grant to Charles Alexander and Partners (Transport), Ltd, Aberdeen, of six vehicles of 24+ tons unladen and five .articulated units of 144 tons unladen on a A licence under which two articulated outfits of 5-1 tons unladen were already held. Nine vehicles of 321 tons unladen and four " artics of 7 tons unladen on special A licence were to be surrendered. The vehicles were based on Aberdeen and the normal user was the carriage of fish and general goods to Elgin, Inverness, Dundee, Glasgow, Edinburgh and elsewhere in Scotland, England and Wales. The aim was to modernize the fleet of 125 lorries.

Mr. W. Cowan, Q.C., for the B.T.C., submitted that it was not a sound proposition in law for the holder of special A and open A licences to claim that he was entitled, without proof, to surrender special-A vehicles in favour of ordinaryA vehicles. Mr. Hubert Hull, chairman of the Tribunal observed that by the substitution Alexander's would suffer some kind of restriction, whereas there was no restriction on the special-A vehicles.
