Which of the following most accurately describes the problem?

AHAULIER who claimed that he had to sell his business because of injuries received in a road accident was awarded damages of £4,500 in the Court of Session at Edinburgh last week. He was Mr. Robert Reid, aged 63, of Falkirk, who sued Taylor's Transport (Buckie) Ltd. for £12,000.

After carrying out a minor repair, Mr. Reid was standing by his lorry on the main road north at Burrelton, Perthshire, on September 21 last year, when a lorry belonging to the defendants ran into the rear of his vehicle. As a result the vehicle fell into a ditch and he was thrown underneath.

Mr. Reid suffered shoulder injuries and as a result he had to sell his business, which earned him £1,200 a year. He was now working as a night-watchman at a wage of £8 a week.

The defendants admitted liability but claimed that the amount sued for was grossly excessive.
