THE NORTH-WESTERN Traffic Commissioner has reserved her decision on Speke, Liverpool-based SCLTransport & Warehousing's application for a new international licence for 10 vehicles and 11 trailers.

The directors are Keith Spencer and Justin Coulthurst. TC Beverley Bell was also considering action against the licence held by Supply Chain Logistics (North West), of which Spencer is a director. There were concerns over the firm's financial standing. Paul Coulthurst, Justin's father, had been a director of Supply Chain Logistics (North West) until he resigned in June 2006. He had had his licence in the name ofJ&J Transport revoked,along with a disqualification for two years in June 2002. He was left with il50,000 of debt.

He became a director of Supply Chain Logistics (North West) in August 2002.The vehicles were transferred to that holding company as he could not be released from the guarantees. He could not be a director of Supply Chain Logistics, a separate company formed by a mergerbetween J&JTransport and Spencer's King Trucking. The warehouse where the business was based was owned by his pension fund. It is now used by SCL Transport & Warehousing.

The SCL application form had been signed by Paul's son Justin but he had helped him by filling it in. Justin Coulthurst said SCL's tachograph records were sent for outside analysis but he did not know the name of the agency.The vehicles were on finance and he thought that was paid electronically.

Asked how the company could legally occupy the premises without a lease, Justin Coulthurst said he did not know. Asked whether the company paid rent, he said he would have to ask their accountant. Asked about various direct debits in the bank statements produced, he again said he would have to ask their accountant. Bell said: "You have to show that it [renting the warehouse from Paul Coulthurst] is an arm's-length transaction and not a sham."
