Which of the following most accurately describes the problem?

month after mounting debts forced Derbyshire-based SAY Transport to call in the receiver, a new firm has applied for an Operators Licence under the same name. But SAY owner Stuart Yates is not named on the application. Ashvale International, which plans to operate as SAY from the same depot in Turnditch, Belper, is bidding for authorisation for 15 trucks and 30 trailers in the North West Traffic Area.

None of the other directors of Ashvale is believed to have been a director of SAY Transport, which collapsed at the end of January leaving 10 drivers jobless (CM 4 Feb).

Yates says he would consider an offer of employment from the new company—he faces a bill from contract-hire company Pentagon Vehicle Rental of Derby for trucks he personally guaranteed. PVR says it is waiting for a hearing date at Derby County Court.

However the receiver of SAY Transport says the directors have not yet contacted it to buy the trading name. It says neither preferred or ordinary creditors will be given a dividend, leaving a handful of haulage subcontractors out of pocket
