AN OPERATOR has appeared before an Edinburgh disciplinary inquiry after allowing a driver to illegally park overnight near his home because of his -tragic family circumstances".
However, Deputy Traffic Commissioner Richard McFarlane took no action against the licence for 65 vehicles and 200 trailers held by Duncan Adams, other than to warn it about its future conduct.
Traffic examiner John Angus said there had been a complaint from another operator about one of Adams' vehicles being parked without authority in Grangemouth.
When the matter was raised with the company, director Catherine Adams wrote to say the vehicle was parked there because of the driver's personal circumstances. The company was advised that it needed to apply for the driver's address to be authorised as an operating centre. Nothing was done and observations and a check on tachograph charts in August and September 2004 showed the vehicle was still being parked at Bridge of Earn overnight.
Angus confirmed there was nothing of real concern and VOSA had worse people to enforce.
The DTC said:"It is so unnecessary this. I am so disappointed for you. The family was given every opportunity to put this administratively in order."
He took no action against the licence, saying he took account of Adams' many years in business and the fact that the incident had no impact on road safety.
