A BERKSHIRE HAULIER has issued a County Court Judgement against Norbert De ntressan gl e (ND) after the French operator refused to pay him when his load was stolen.

Bradley Nussey's insurers even wrote to ND in September, claiming that withholding payment "is considered illegal under English law". But it was only when CM phoned ND's legal director in France that the French logistics giant promised to settle the £3,000 bill "in the next few days".

Nussey, who trades as BS Nussey Haulage of Hungcrford, was hauling a load for ND in July when thieves broke into his trailer and stole 42 combination boilers as he slept. Nussey says ND passed the claim on to its French customer and was waiting to be paid before crediting his account.

However, a letter from a Royal & Sunalliance claims handler to ND warned: "At this stage [ND] has not suffered any financial loss and as such there remains no justifiable reason for the deduction."

Nussey says: "ND shrugged their Gallic shoulders —they aren't interested. Why should they chase it up for me? I have put it into Newbury Magistrates Court as a had debt.

When CM spoke to Patrick Lheureux at ND, he said: "The problem is that there is a claim.We are in discussions with the insurance company. It will be settled in the next few days."
