THE EUROPEAN Court of Justice (ECJ) has overturned a truck ban on a motorway in the Austrian Tyrol that links Germany to Italy.

In 2003 the Tyrol government banned trucks over 7.5 tonnes from a 46km section of the AU in the Inn valley, in an attempt to fight air pollution in the Alps. But the ECJ has backed European Commission claims that the ban broke EU rules on the free movements of goods so it must be lifted. Before taking "so radical a measure", it argues, the Tyrolian authorities should have "examined the possibility of using less restrictive measures".
