AN OPERATOR WHOSE brother failed to fulfil his role as transport manager for two years. and who used an unauthorised operating centre, is waiting to find out if he will lose his 0-licence.

North Western Deputy Traffic Commissioner Elizabeth Perrett was considering action against the one-vehicle licence held by P&D Catering, trading as Robert Pickavance & Son of Rufford. Lancs. She was also hearing an application for a restricted licence by the company's transport manager, John Pickavance, trading as Al Contractors & Plant Hire.

Appearing for John Pickavance, Jonathan Backhouse agreed his client had not carried out the transport manager's role for his brother Robert's company since 2005.

Vehicle examiner Andrew Lees said P&D Catering bought and sold farm machinery and the declared operating centre was Tollgate Road, Burscough, Lancs. However, Robert Pickavance had instead used two other sites in Rufford and then Preston.

The DTC was told the company was seeking to downgrade its national licence to a restricted licence, which meant it did not require a qualified transport manager. Robert Pickavance said the company held a national licence for convenience, as farmers occasionally hired the firm to move equipment. The operating centre had not been at Burscough during his ownership of the company; he claimed that the vehicle had been moved from Rufford because of vandalism by neighbours that was why it had been parked in Preston.

John Pickavance confirmed that he had been the transport manager before the firm was transferred to his brother. Once Robert had taken over, John Summary simply left it to him. John Pickavance had stayed on the licence to help out.and had found that he needed an 0-licence for his own business after his vehicle was impounded.

The DTC is to announce her decision in writing.
