chris.tindatilarbi.co.uk A DISPUTE OVER unpaid money between pallet network Pall-Ex ( UK) and Brian Yeardley Continental has been settled out of court.

The two companies were at loggerheads over money both sides claimed was owed to each other when the Yorkshire haulier left the network in September 2008.

Brian Yeardley says he joined the network six months earlier, but struggled to put enough traffic through it to maintain profitability, He says: "After six months I said if you don't let me get out of this. I will go bust. I didn't know anything about pallet networks If you don't have substantial traffic to put through it, you shouldn't be in it."

Yeardley says that the company continued taking money from his firm's bank account after it left without him realising, which he claims totalled more than £60,000. He says Pall-Ex then paid him most of it back, but they became embroiled in a dispute over how much each side was owed. Pall-Ex, plus third-party claimant Pall-Extra, has now agreed to pay a four-figure sum to the Yorkshire haulier as a contribution towards its costs A Pall-Ex spokeswoman says: "The claim by Brian Yeardley against Pall-Ex and the counterclaim by Pall-Ex against Brian Yeardley have been withdrawn by each of the parties without any admission of liability by either in respect of the matter and without any payment being made by either in respect of the settlement of the claim. The order is absolutely clear in this respect.

"The matter was compromised on the basis of purely commercial considerations, with both sides maintaining their positions throughout and with a small contribution to costs being made in respect of previously adjourned applications:"
