Licence refused for cabotage rule-breaking

LAVELLE TRANSPORT has been refused an international 0-licence after being found guilty of flouting the cabotage rules.

William Lavelle, director and transport manager of the Motherwell, North Lanarkshire-based firm, had applied for a standard international goods vehicle licence for five vehicles and five trailers.

However, a public inquiry heard Lavelle, who undertakes haulage for Norfolkline, had been operating under a Dutch licence, while using the majority of his trucks for UK journeys only. As European cabotage provisions require that all vehicles return home to the country of authorisation, he was found to be operating unlawfully.

Refusing the licence, Scottish Traffic Commissioner Joan Aitken said: This applicant has operated non-compliantly using a Dutch licence. As recently as the three months to the end of January 2010, there was non-compliance with the tachograph and drivers' hours rules. What message would granting this application send to all those good operators who operate with repute and who invest in proper systems?"
