IN an appeal decision announced last 1 week, the Minister of Transport reaffirmed an earlier decision in defining as "too narrow a view" an observation by one of his inspectors that an " existing operator" is an operator already licensed, or who has applied for a licence, to provide a service.

He has, however, rejected the appeal by Messrs. Swinard's Luxury Coaches against the South-Eastern Licensing Authority's refusal to grant them a licence to run excursions from Ashford to Wembley.

The Minister agreed with his inspector, Mr. J. M. Glen, that as the appellants had not appealed against the grant of a licence to the East Kent Road Car Co., Ltd., it was necessary for them to establish evidence of need for facilities over and above those already licensed to that company. This need bad not been proved, and It was on this ground alone that the appeal failed.

Costs were awarded against Messrs. Swinard's.
