Which of the following most accurately describes the problem?

1-1 A FINE of £30 was imposed by

Ludlow magistrates, last week. upon Robert Eric Bosworth, a farmer, of The Measoms Farm, Middleton, Ludlow, for using a farm vehicle for which a higher rate of duty should have been paid. Defendant denied the offence, but admitted a second charge of having no carrier's licence. He was stated to be an agricultural contractor as well as a farmer.

Mr. P. Rushworth, prosecuting, said that the first charge concerned a lorry which had been registered for farm purposes only. As such, the licence cost £19, but if the lorry were used for other purposes the duty should have been £72 3s.

Police had stopped the lorry on three occasions when it was carrying plant. Mr. I, A. Slater, defending, stated that the prosecution had not proved that Bosworth was carrying on an agricultural contractor's business. On the three occasions mentioned the lorry was carrying machinery which might well have been for use on defendant's farm.

Bosworth was given an absolute discharge on the second summons on payment of 4s. costs.
