Which of the following most accurately describes the problem?

T1IE M. of W.T. has recently sent to trade associations, for their observation, a letter in which he refer* to representations received by the Ministry, from time to time, that persons obtaining licences to acquire new vehicles on the ground that their existing machines are beyond repair have, in many cases, offered the latter to the highest bidders. In some instances the purchasers have then used valuable labour and spare parts to give them a further short life.

This practice is clearly undesirable, and the Minister suggests the" following procedure for preventing it:--,(1.) To amend 'the Acquisition and Disposal of Motor. Vehiclei Order, 1942, by adding a. clause to the folloiving effect:—Where the new vehicle is required to replace one registered, it may be a condition of the licence that the latter shall be disposed of in a manner prescribed in th€ licence, and the vehicle acquired not used until this

condition has been fulfilled. About two months usually elapse between the issue of a licence to acquire and delivery; dating this period the operator can make the necessar, . arrangements: to comply with the condition. (2) Where the' licence is granted to .replace a worn-out vehicle some condition, such as follows, will be placed upoa the licence:—That the vehicle of which the registration number is — shall be sold to a car breaker approved by the Ministry of Works and building,s.

Whore the operator is in a substantial way and in a position properly to break up the vehic1e and to use the spares on his other machines, the condition can be modified to the effect that the particular vehicle Will be broken down for spares in the licence holder's workshop.

(3) ApproVed car breakers as well will be required to give an undertaking to break down for scrap metal, as soon .as possible, all vehicles purchased from persons who have been authorized by the M. of W.T. to acquire vehicles to replace them, and not to repair the replaced vehicles for use on the road. An undertaking will also have to be given to dispose of the scrap metal without unavoidable delay.

(4) Before a defence permit is issued by the Commissioner, he will require a receipt or undertalgng in one of the following forms from the licence holder:—(a) From an approved car. breaker to the holder of a licence to acquire, certifying that he has taken possession of the motor vehicle concerned in the licence and undertaking, to break it down for scrap and to dispose of the scrap as soon as possible; (b) an undertaking from an operator who has permission to break down a vehicle for spares in his own workshop, that such vehicle is being broken down and will be disposed of as so-m as possible to a licensed scrap merchant or approved car breaker.

These forms of receipts and undertakings will be issued with the licences to acquire.

It is not the intention to break down serviceable vehicles, and in all cases of replacements applicants must state what they propose to do with the existing vehicles, and this will be taken into consideration by the Commissioner when forwarding the applications: It may be that a licence for a new vehicle is granted because the existing one is not large enough or is unsuitable for the purpose for which the new vehicle is required, and the question of conditions'attached to the licence will then depend upon the report of the Commissioner.
