A Coventry haulier who assumed that an application to change his operating centre had been granted has had his licence suspended for three weeks. In addition,

West Midland Traffic Commissioner David Dixon cut the authorisation on the licence held by Andrew Carr from three vehicles and one trailer to two vehicles. For Carr, Michael Carless said that the change of operating centre had been advertised in December 1999. A copy of the advertisement had been sent with the application and Carr had heard nothing since.

It now appeared that the application had never been received by the Traffic Area Office, though the TAD had a copy of the advertisement and had received representa

tions from local residents.

Vehicle examiner Kerry Benson said that Carr had moved from Nuneaton and had been operating from Coventry for the past two years.

She described two instances where vehicles presented for annual test had failed—one was described as "being in a sorry state". In September 2001, she told the inquiry, a badly loaded artic belonging to Carr hit a kerb and rolled over. The police found that the tachograph had not had its two-yearly or sixyearly calibration check.

However, Carless suggested there must have been exceptional circumstances relating to that accident as the police had only prosecuted for the tachograph calibration offence.

Carr said he was now only operating one vehicle. He had initially moved the workshop side of the business to Coventry, but when he decided to move the whole operation he made a variation application. As he was getting core spondence from the Traf Area at his new busine address he assumed that had been authorised.

Dixon commented th there was no record of a application being received, a pointed out that when a Vat examiner had visited Carr March 2000 he had be advised to make a fresh ag cation as soon as possible. did not seem to have done th.
