INSECURE WHEELS on a tipper have costa London operator £1.465 in fines and costs. Charltonbased Aggregate Tippers and one of its drivers were found guilty of using a vehicle in a dangerous condition when they appeared before the Barking magistrates.

The company and its driver, Gary Pamphlett, of Rochester, admitted the offence after a pair of wheels were found to be insecure.The company was fined £800 with £350 costs; Pamphlett was fined £200 with £115 costs. He was also fined £80 for exceeding 41/2 hours' driving without the required break.

Prosecuting for Vosa, Anthony Ostrin said the vehicle concerned had been stopped in a roadside check. A vehicle examiner found that two of the 10 nuts securing the offside wheel on the third axle were loose, This could easily be seen by anyone standing next to the vehicle. The vehicle examiner considered this to be a long-standing defect.

The vehicle also had a defective tyre on the inner offside wheel on the third axle.

Pamphlett had admitted he had not checked the nuts. AggregateTippers director Philip Fitzsimmons had said the tyres on the company's tippers were regularly removed and he relied on an outside tyre firm to change the wheels.

He had added that wheelnuts were normally checked when the tyres were changed.

Appearing for the corn pany,Jeremy Fear said it had relied on the driver to check the wheels and he had clearly not done so.

In a letter to the court Pamphlett said the vehicle had not been equipped with a wheel brace so he had been unable to make the check.
