Atkin 8(.. Sons has lost its Operator's 41 Licence and its directors have been disqualified from holding one for 15 months after they failed to comply with a number of undertakings given at a previous Public Inquiry. The company, which held a licence for six vehicles, had been called before North

Eastern Traffic Commissioner Tom Macartney at a Leeds disciplinary inquiry.

Senior vehicle examiner Clive Allison had examined four of the company's vehicles in September, issuing two immediate prohibitions and four defect notices. Defects on one vehicle had been listed on the previous inspection record six weeks before, and it was clear that the maintenance contractor had not been authorised to rectify them.

There were a number of other problems as well: • The periods between inspections varied between six and 10 weeks, instead of the four weeks agreed at a previous inquiry; • There was no evidence of the drivers daily nil defect reporting system that had been requested by the TC; • The initial pass rate at annual test was 50%, when the agreed target was 85%.

• An undertaking that a member of the family would obtain a CPC had not been fulfilled; • No one had attended a new operator's seminar, as had been promised.

Appearing for the company, Paul Carless said Matthew Atkin, who was responsible for these lapses, was no longer with the company. Carless addec that the directors had put a In of faith in Atkin but eventuall! decided they had picked th( wrong man.

Director Gary Atkin told thi IC that a former haulier ha( been employed as the corn pany's CPC holder in Februari and since then things hat improved. Hi reported that the. had spent £23,001 on the vehicles ove the past 12 months Revoking th licence, Macartney said he ha been told on the last occasio that if a licence were grante the company would operate i an exemplary fashion and Gar Atkin would be personall responsible. Promises given z a Public Inquiry could not b given lightly, and there was n doubt that the company ha been made aware that it wa essential to carry out thos promises.
