A Manchester industrial tribunal heard that James McPhilbin was not under contract to drive vehicles at MDS's Trafford Park depot, although he occasionally did so.

On October 16 he was ordered to drive a vehicle and refused because he considered there were other people on hand who could do the job. He was immediately suspended and dismissed the following day.

The tribunal said it preferred Mr McPhilbin's evidence to the written representations submitted by the company.
