USING A vehicle without 0-licence authority has cost a hot dog salesman £1,200 in lines and costs.
Norman Prior,trading as Filling the Gap,of Binfield, Berkshire, pleaded guilty to having no 0licence and failing to use a tachograph when he appeared before the Harlow magistrates.
Anthony Ostrin, prosecuting for VOSA, said a 7.5-tonner driven by Prior had been stopped in a roadside check at North Weald Bassett. The vehicle was loaded with a generator and water bottles. Prior had admitted that he had no 0-licence and was not using the tachograph. He had claimed to be a member of the Showman's Guild and therefore exempt from both the 0-licensing and tachograph regulations. However, he had failed to produce a guild certificate membership number and had been requested to forward a copy of the certificate. No such certificate had been received.
Prior told the magistrates that as he had been driving a vehicle that had been adapted to be a showman's vehicle he had considered himself to be exempt from the regulations.
He said he needed a big vehicle to carry his generator, but accepted that he was a mobile caterer and the vehicle was in fact a hot dog van. He agreed he had been working in the business for more than 10 years without an 0-licence or using the tachograph.
The magistrates tined Prior £1.000 with 1200 costs for having no 0-licence. No separate penalty was imposed for failing to use the tachograph.
